Happy Thanksgiving

This time of year brings out the best & worst in many. The important thing is to remember you have friends & family and you are here to enjoy them. Don’t get caught up in the negatives.

Many people use only this time to really think of what they are thankful for, when in reality you should always be thankful for what you have. Don’t waste time on wishing for more when you will miss the opportunity to enjoy what you have.

The Massachusetts State of Emergency

On October 29th, 2011 the Governor of Massachusetts declared a state of emergency due to the power outages caused by the early winter storm. The heavy wet snow and wind conditions caused most of the Commonwealth areas power outages.

Businesses have had to close down, roads were closed, and emergency shelters were set up. (MEMA) Massachusetts Emergency Management Agency is the state agency that handles and coordinates the local, state and federal help as well as the volunteer resources when disasters strike the Commonwealth of Massachusetts.

This Nor’ Easter storm has halted many on the east coast causing several top schools to close across the state including but not limited to Franklin, Worcester, Middlesex, Norfolk counties. Nearly 1 million people were without power. Halloween trick or treating has been forced to be postponed; traveling is at a stand still in many areas as well. Many people on the east coast are still regrouping from Irene, the storm that hit just a few months ago.

While help is being sent in from other states and areas, the outlook is grey when you’re inside the disaster areas. It will be better as the week progresses. For some who are within the Winchester real estate market, moving right now will be quite challenging. A special lock placed on the door of a listed property designed to facilitate the broker’s showing of that property. The house keys are located inside the lock box. This way, a cooperating broker wanting to inspect the property need not go to the listing broker’s office for the house keys but merely calls the listing office for the lock box combination. Some lock boxes have locks that open with keys, others can be opened with digital devices.

Lack of ordinary care in installing the lock box or providing the combination or special key could result in liability for property damage, theft, or personal injury. Some errors and omissions insurance policies now have a special lock box liability endorsement.

One who acts as an intermediary between parties to a transaction. A real estate broker is a properly licensed party (individual, corporation, or partnership) who, for a valuable consideration or promise of consideration, serves as a special agent to others to facilitate the sale or lease of real property.

A real estate broker is an independent businessperson who sets the office policies. A broker hires employees and salespeople, determines their compensation, and supervises their activities. The broker is free to accept or reject agency relationships with principals.

Brokers represent their principals and accept the fiduciary responsibility of exercising care, skill, and integrity in carrying out their instructions. Generally, a broker’s duties are confined to advertising property and to finding a person ready, willing, and able to deal on the terms stipulated by and acceptable to the principal. However, legal restrictions are imposed on brokers by legislative action, and federal, state, and local fair housing laws place new social obligations on them. Brokers cannot legally refuse, due to race, religion, sex, or national origin, to show, sell, rent, or otherwise negotiate regarding property listed with them. The broker must submit all offers to the principal.

To qualify as a real estate broker, one must meet the requirements set forth in the real estate license law of the state in which one intends to practice. This generally involves passing a written examination, meeting educational requirements, evidencing good character, and paying the required fees.

A broker is permitted by law to hire others to assist the brokerage in representing its clients. Some brokers continue to sell actively, some are sales managers, and others are primarily administrative brokers doing little or no listing and selling.

The broker is the primary agent in any agency relationship with buyer or seller. This is true even though the salespeople, who are agents of the broker, have most of the direct contact with the buyer or seller client.
